COSAL Files Comments on Rule 23 Service Awards

COSAL filed comments with the Federal Rules Committee regarding Rule 23 service awards.  The comments were drafted by Justin Cole and Candice Enders of Berger Montague.

This comment is intended to nudge the Rules Committee to make changes that would abrogate the 11th Circuit’s decision to ban service awards, which are allowed in every other circuit. Service awards serve a critical function in compensating class representatives for the important work they do in bringing the claim and to incentive others to do the same.
