The proposed amendment partially resolves a circuit split and will allow parties in complex cases to narrow the pending issues during pretrial proceedings. They promote efficiency and speed in resolving cases.

This comment is intended to nudge the Rules Committee to make changes that would abrogate the 11^th Circuit’s decision to ban service awards, which are allowed in every other circuit. 

The brief urges the reversal of a district court decision that misapplies Third Circuit precedent announced in LePage’s Inc. v. 3M, 324 F.3d 141 (3d Cir. 2003), and consistently followed since.
