COSAL Pushes DOJ and FTC to Modernize Antitrust Guidance for the AI Era

Today, COSAL took the lead in urging the Department of Justice and Federal Trade Commission to modernize federal antitrust guidance governing collaboration among competitors. In formal comments filed with both agencies, COSAL pressed for clear, updated guidance that distinguishes between conduct that is high risk for anticompetitive harm, low risk, and presumptively illegal. COSAL also urged regulators to directly address emerging competitive threats posed by artificial intelligence, algorithmic coordination, and the growing use of common agents in the marketplace.
